Ohio Revised Code § 3113.31(E)(1) outlines the provisions that a court can include in a protection order after a hearing. These provisions are designed to protect individuals from domestic violence and ensure safety within the household. They may direct the respondent to refrain from abusive behavior, grant possession of the residence to the petitioner, allocate parental rights temporarily, and more. Such orders are crucial for safeguarding victims and maintaining peace.
Under Ohio Revised Code § 2919.27, violating the terms of a protection order is a serious offense with varying penalties depending on the circumstances:
If a person recklessly violates the terms of a protection order, they may face a first-degree misdemeanor charge. This offense carries penalties of up to 180 days in jail and/or fines reaching $1,000.
In more severe cases, such as repeated violations or violations coupled with felony offenses, the charge escalates to a fifth-degree felony. Penalties for this level of offense can result in imprisonment ranging from six to 12 months and fines up to $2,500.
If a protection order violation occurs concurrently with a felony offense, the charge rises to a third-degree felony. Conviction at this level can lead to imprisonment from nine months to five years, alongside fines as high as $10,000.
In instances where the protection order mandates electronic monitoring of the offender, the court may extend supervision for up to five years beyond any other sentence imposed.
