The list continues to define various bulk amounts for different controlled substances, including phencyclidine, stimulants, depressants, anabolic steroids, and Schedule III to V substances.
The criminal penalties for drug trafficking are categorized by the schedule of the controlled substance and the quantity involved. For Schedule I or II substances, if the amount is less than the bulk amount, the offense is classified as a fourth-degree felony. If the offense occurs near a school or juvenile, it is elevated to a third-degree felony. The severity increases with larger quantities, reaching up to a first-degree felony for amounts exceeding 50 times the bulk amount. Similarly, Schedule III, IV, or V substances carry penalties ranging from a fifth-degree felony for less than the bulk amount to a first-degree felony for amounts more than 50 times the bulk amount when near a school or juvenile.
Marijuana-related offenses are penalized based on quantity as well. Possession of less than 20 grams can result in a minor misdemeanor, which escalates to a third-degree misdemeanor if the offense occurs near a school or juvenile. Larger quantities can result in felonies, with the severity increasing based on the amount and proximity to a school or juvenile. For example, possession of 40 kilograms or more of marijuana is classified as a second-degree felony, elevated to a first-degree felony near a school or juvenile.
Cocaine offenses carry strict penalties. Possession of less than 5 grams is classified as a fifth-degree felony, elevated to a fourth-degree felony near a school or juvenile. Possession of larger quantities results in more severe charges, with over 27 grams classified as a first-degree felony. LSD is penalized similarly, with solid doses and liquid doses each having specific thresholds that determine the severity of the felony charge.
Heroin offenses are severely penalized, with possession of less than 1 gram or 10 unit doses classified as a fifth-degree felony. This can be elevated to a fourth-degree felony near a school or juvenile. Possession of larger quantities leads to higher-degree felonies, with amounts over 50 grams or 500 unit doses classified as first-degree felonies. Controlled substance analogs and fentanyl-related compounds also have specific thresholds that determine the severity of penalties.
Federal drug trafficking charges can result in even more severe penalties. For example, possession of 500 grams to 4,999 grams of cocaine carries a mandatory minimum sentence of five years up to 40 years in prison for a first offense. If the offense involves death or serious bodily injury, the minimum sentence increases to 20 years to life in prison. Subsequent offenses carry harsher penalties, with life sentences possible. The fines can be substantial, with individuals facing fines up to $5 million for a first offense and up to $8 million for a second offense.
Similarly, offenses involving significant amounts of other controlled substances, such as cocaine base, fentanyl, fentanyl analogues, heroin, LSD, pure methamphetamine, and PCP, carry mandatory minimum sentences and substantial fines. For example, possession of 1 kilogram or more of heroin can result in a mandatory minimum sentence of 10 years up to life in prison, with fines up to $10 million for individuals on a second offense.
