Learn more about our teamAt Sabol Mallory LLC, we understand how worried you might be about your future if there is a warrant out for your arrest. We are here to help and offer support to the Columbus, Ohio community during this challenging time.
There are two main types of warrants in Ohio. The most common is the arrest warrant. A judge usually approves this after a police officer presents enough evidence showing probable cause to arrest a suspect for a crime. In most arrest warrant cases, an officer needs to conduct an investigation and collect evidence to support the warrant. An arrest warrant is typically issued when someone is believed to have committed a criminal offense.
The other type of warrant is called a bench warrant. This is usually issued by a judge from the bench, hence the name. When the individual has been charged with a felony, it is called an alias capias warrant. Bench warrants and alias capias warrants are most commonly issued when people fail to appear in court. If you are arrested on an alias capias warrant, you cannot bond out until your next court date. Warrants can also be issued for reasons other than failing to appear in court, such as failure to pay traffic tickets, child support, or violations of probation.
According to Ohio Revised Code § 2937.99, failing to appear in court as required after being released on your own recognizance is a crime. The penalties depend on the original charge. If the release was connected to a felony charge or a pending appeal after a felony conviction, failure to appear is a fourth-degree felony. This can lead to six to 18 months in prison and/or a fine of up to $5,000. If the release was connected to a misdemeanor charge or for appearing as a witness, failure to appear is a first-degree misdemeanor. This can result in up to 180 days in jail and/or a fine of up to $1,000.
If you know that there is an active warrant out for your arrest, you have several options to resolve it. Some areas have self-arrest programs where you can surrender to authorities; another option is to appear in court with your lawyer to file a motion to surrender. You could also ask the judge for a favorable release. Other possible motions include filing for an emergency bond reduction due to urgent circumstances or a motion to withdraw a bench warrant or alias capias because of an unintentional failure to appear.
If your warrant is related to a domestic violence crime, getting the warrant set aside will require both you and the alleged victim to be present with law enforcement, the prosecutor, and a court reporter. The alleged victim must also meet with a victim advocate.
It is important to understand that you cannot simply wait out warrants. The warrant will stay active until you are taken into custody. Even worse, arrest warrants are usually shared by multiple law enforcement agencies. This means you could be arrested in another state while on vacation because of a missed court appearance in Ohio. Living on the run, always looking over your shoulder, is not a good way to live. It is much easier to resolve whatever issue led to your warrant.
