This must occur when another person, who is not an accomplice of the alleged offender, is present, with the intent to commit any criminal offense in the structure or secured portion of it. Additionally, burglary includes trespassing in an occupied structure or in a separately secured portion that serves as a permanent or temporary habitation of any person, with the intent to commit a criminal offense when any person other than an accomplice is present or likely to be present. These violations are considered second-degree felonies and carry severe penalties, including two to eight years in prison and/or a fine of up to $15,000.

      Moreover, if a person uses force, stealth, or deception to trespass in an occupied structure or a separately secured portion of it with the intent to commit any criminal offense, this is also considered burglary. This violation is categorized as a third-degree felony and is punishable by nine months to five years in prison and/or a fine of up to $10,000.

      Aggravated Burglary: A More Serious Offense

      Aggravated burglary is defined under Ohio Revised Code § 2911.11. A person commits aggravated burglary if they use force, stealth, or deception to trespass in an occupied structure or a separately secured portion of it. This must occur when another person, who is not an accomplice, is present, with the intent to commit any criminal offense. Additionally, the offender must either inflict, attempt, or threaten to inflict physical harm on another person or have a deadly weapon or dangerous ordnance on or about their person or under their control. Aggravated burglary is a first-degree felony and carries even more severe penalties, including three to eleven years in prison and/or a fine of up to $20,000.
