Violating these regulations is considered a first-degree criminal misdemeanor and can result in up to 180 days in jail.

      Penalties for CDL DUI/OVI Offenses

      The consequences of a CDL DUI/OVI conviction in Ohio can be severe. Ohio Revised Code 4506.16 outlines the disqualification periods for various offenses. If you commit two serious traffic violations within three years, you could face a 60-day disqualification from driving commercial vehicles. Three serious traffic violations within three years result in a 120-day disqualification. A first conviction for driving with a BAC of .04 or higher, driving under the influence of a controlled substance, or committing an OVI/DUI in any motor vehicle leads to a one-year disqualification. If these offenses occur while driving a vehicle with a hazardous materials placard, the disqualification period is extended to three years.

      For those with multiple convictions, the penalties are even more severe. A second conviction for driving with a BAC of .04 or higher, driving under the influence of a controlled substance, using a motor vehicle to commit a felony, or refusing to submit to a breath, blood, or urine test results in a lifetime disqualification from driving commercial vehicles. The same lifetime disqualification applies for a first conviction of using a motor vehicle to commit a felony drug offense.
