Offenses under this statute are generally second-degree felonies, and possessing or viewing such material can be charged as a fourth-degree felony.

Additionally, the production of sexually explicit depictions of a minor for importation into the United States is covered under 18 U.S.C. § 2260. State crimes related to child pornography in Ohio carry severe penalties. A fourth-degree felony can result in six to 18 months in prison and a fine of up to $5,000. A second-degree felony can lead to two to eight years in prison and a fine of up to $15,000.
