In Columbus, Ohio, the penalties for drug crimes can be severe, and the consequences of a conviction can have a lasting impact on your life. The federal Controlled Substances Act (CSA) divides controlled substances into five schedules, each carrying different penalties.
Schedule I substances have no accepted medical use and a high potential for abuse. These include marijuana, heroin, LSD, and MDMA.
Schedule II substances also have a high potential for abuse and can lead to severe dependence. These include cocaine, methamphetamine, and oxycodone.
Schedule III substances have a moderate to low potential for dependence and include anabolic steroids and ketamine.
Schedule IV substances have a low potential for abuse and low risk of dependence, such as Valium and Xanax.
Schedule V substances have a lower potential for abuse than Schedule IV and include certain cough preparations with limited quantities of codeine.
Ohio’s drug schedules follow the federal schedules closely, and any changes at the federal level automatically apply to the state schedules. The classification of a drug affects the severity of the charges and the penalties you could face. Some offenses may result in mandatory jail or prison terms, highlighting the importance of having a knowledgeable lawyer by your side.
Ohio law addresses various drug crimes under Chapter 2925 of the Ohio Revised Code. These crimes include corrupting another with drugs, trafficking and aggravated trafficking in drugs, illegal manufacture of drugs, illegal assembly or possession of chemicals for drug manufacture, and funding or aggravated funding of drug trafficking. Other offenses include illegal administration or distribution of anabolic steroids, dangerous drug offenses involving livestock, possession of controlled substances, and possessing drug abuse instruments.
Permitting drug abuse, illegal use or possession of drug paraphernalia, illegal use or possession of marijuana paraphernalia, and deception to obtain a dangerous drug are also covered under Ohio law. Additional charges include illegal processing of drug documents, tampering with drugs, abusing harmful intoxicants, trafficking in harmful intoxicants, possessing nitrous oxide in a motor vehicle, sale of pure caffeine products, and illegal dispensing of drug samples. Counterfeit controlled substance offenses are also addressed in the Ohio Revised Code.
In some cases, an individual may face multiple drug charges from the same incident. Federal charges typically apply in cases involving large quantities of drugs or interstate violations. In Ohio, judges have some discretion in sentencing, making it crucial to have a lawyer who can present all possible mitigating circumstances to the court.

Any kind of criminal drug charge can be frightening, but keep in mind that a prosecutor still has a burden of proving your guilt beyond a reasonable doubt. This is not always easy when an experienced criminal defense attorney is able to look at the facts of your case. Many drug arrests involve illegal searches or seizures that are violations of an alleged offender’s Fourth Amendment rights. In such cases, the drugs that are confiscated by police then become inadmissible as evidence and a prosecutor must throw the case out.
Another possible constitutional violation in some cases concerns police failure to advise a person of their right to remain silent, otherwise known as their Miranda rights. Such failures constitute a violation of a person’s Fifth Amendment rights. Another very common defense in many drug possession cases relates to constructive possession, as a person can be charged with possessing drugs that were found in an area over which they had control. The controlled substance that is identified by police, however, may have belonged to another person and an alleged offender could be able to avoid a conviction by proving the drugs did not belong to them.
Many other different defenses can be applicable in certain cases depending on specific circumstances. Some crimes may not involve a required criminal intent and other cases could have involved some form of entrapment by law enforcement. At Sabol Mallory LLC, our experienced lawyers are skilled at identifying the best defenses for your case and presenting them effectively in court.
