Ohio Revised Code § 3113.31(A)(1)(a) broadly defines domestic violence as any act committed against a family or household member that includes attempting or recklessly causing bodily injury, inducing fear of imminent harm, committing acts that result in child abuse, or engaging in sexually oriented offenses. Moreover, under Ohio Revised Code § 3113.31(A)(1)(b), these acts extend to individuals in dating relationships characterized by romantic or intimate involvement.
The term “family or household member” encompasses various relationships, including spouses, former spouses, parents, children, and other relatives living or previously residing with the alleged offender. The legal framework favors arrest over summons in domestic violence cases to prevent immediate escalation.
Ohio Revised Code § 2919.25 outlines domestic violence as knowingly causing physical harm, recklessly causing serious harm, or inducing fear of imminent physical harm through threats against a family or household member. Penalties escalate for repeat offenses or when the victim is pregnant, potentially leading to felony charges under specific circumstances.
Additional family-related offenses detailed in Chapter 2919 of the Ohio Revised Code range from pregnancy termination without consent to interference with custody or support orders. Depending on the severity, these crimes may carry misdemeanor or felony consequences upon conviction.

• Felonies: First-degree felonies may carry sentences from three to 11 years in prison, with fines up to $20,000, whereas fifth-degree felonies could result in six to 12 months in prison and/or fines up to $2,500.
It’s crucial to note that domestic violence convictions cannot be expunged or sealed, potentially impacting firearm possession rights, professional licenses, housing, and employment opportunities.

Sabol Mallory LLC can explain the potential penalties you may face and develop a defense strategy tailored to your specific situation.
