Many property crimes in Ohio involve a “mens rea” element, which requires the prosecutor to prove that you had a specific criminal intent. Ohio law defines mental culpability into four different degrees. The first degree is intentional or purposely. According to Ohio Revised Code § 2901.22(A), a person acts purposely when it is their specific intention to cause a certain result. It also applies when the offense prohibits conduct of a certain nature, regardless of the offender’s intent to accomplish it. The second degree is knowingly. Under Ohio Revised Code § 2901.22(B), a person acts knowingly when they are aware that their conduct will probably cause a certain result or is likely of a certain nature. A person has knowledge of circumstances when they are aware such circumstances probably exist. This is established if a person believes there is a high probability of its existence and fails to make inquiry or acts with a conscious purpose to avoid learning the fact.
The third degree is recklessly. According to Ohio Revised Code § 2901.22(C), a person acts recklessly when they disregard a substantial and unjustifiable risk that their conduct is likely to cause a certain result or is of a certain nature. A person is reckless with respect to circumstances when they disregard a substantial and unjustifiable risk that such circumstances are likely to exist. The fourth degree is negligently. Under Ohio Revised Code § 2901.22(D), a person acts negligently when, because of a substantial lapse from due care, they fail to perceive or avoid a risk that their conduct may cause a certain result or be of a certain nature. A person is negligent with respect to circumstances when, because of a substantial lapse from due care, they fail to perceive or avoid a risk that such circumstances may exist.
Besides the mens rea elements, there are other possible defenses in property crime cases. One common defense is mistaken identity, where you may have been wrongly identified as the perpetrator. Another defense is justification, such as self-defense or defense of another person or property. These defenses can be complex, and having an experienced attorney to help present these arguments is vital.

The decisions you make immediately after your arrest can significantly impact the outcome of your case. Here are some common mistakes to avoid and how Sabol Mallory LLC can help you through this challenging time.
One of the biggest mistakes people make after being arrested is talking to the police without an attorney present. Anything you say can be used against you in court. It is crucial to exercise your right to remain silent and request an attorney immediately. At Sabol Mallory LLC, our Columbus property crime attorneys will protect your rights and ensure that you do not say anything that could jeopardize your case.
In today’s digital age, it is tempting to share every aspect of your life on social media. However, posting about your arrest or the details of your case can be detrimental. Prosecutors and law enforcement officers often monitor social media accounts for incriminating evidence. It is best to refrain from discussing your case online and to adjust your privacy settings to limit access to your accounts.
Another common mistake is attempting to contact the alleged victim or witnesses involved in your case. Doing so can be seen as an attempt to influence their testimony or intimidate them, which can lead to additional charges. It is important to let your attorney handle all communications related to your case. The team at Sabol Mallory LLC will manage these interactions professionally and legally to protect your interests.
Failing to attend court dates or respond to legal documents can have serious consequences. Missing a court appearance can result in a warrant for your arrest, and ignoring legal documents can lead to default judgments against you. It is essential to stay organized and keep track of all your court dates and legal obligations. Our Columbus property crime attorneys at Sabol Mallory LLC will help you stay on top of your case and ensure that you meet all your legal requirements.
Waiting too long to seek legal advice is another critical mistake. The sooner you have an experienced attorney on your side, the better your chances of achieving a favorable outcome. Early legal intervention can help preserve evidence, secure witness statements, and develop a strong defense strategy. At Sabol Mallory LLC, we offer free consultations to discuss your case and provide guidance on the best course of action.

The penalties for property crimes in Ohio vary depending on the specific crime and its severity. Penalties can range from misdemeanors with fines and short jail sentences to felonies with lengthy prison terms and substantial fines. For example, vandalism can be a fifth-degree felony with up to 12 months in prison and fines up to $2,500, while aggravated robbery is a first-degree felony with potential prison time ranging from three to 11 years and fines up to $20,000. It is possible to have a property crime charge reduced or dismissed, but this depends on the specifics of your case. Factors such as the evidence against you, any prior criminal record, and the circumstances surrounding the alleged crime will all play a role in determining the outcome. At Sabol Mallory LLC, our Columbus property crime attorneys will thoroughly investigate your case, identify any weaknesses in the prosecution’s evidence, and explore all possible defenses to achieve the best outcome for you.
Even if you plan to plead guilty, having an attorney is crucial. An experienced attorney can negotiate with the prosecution to secure a more favorable plea deal, potentially reducing the charges or penalties you face. Additionally, your attorney can ensure that your rights are protected throughout the legal process and that you fully understand the consequences of your plea. Sabol Mallory LLC will provide you with the guidance and representation you need, regardless of your plea.
There are several defenses that can be used in property crime cases, depending on the circumstances. Common defenses include lack of intent, mistaken identity, and lack of evidence. Many property crimes involve a “mens rea” element, which means the prosecution must prove that you had a specific criminal intent. Ohio law divides mental culpability into intentional, knowingly, recklessly, and negligently. Proving that you did not have the required intent can be a strong defense. At Sabol Mallory LLC, our attorneys will carefully examine all aspects of your case to build the most effective defense strategy.
The duration of a property crime case can vary based on its complexity and whether it goes to trial. Some cases may be resolved in a few months, while others can take a year or longer.
