Rape is defined under Ohio law in section R.C. 2907.02. According to this law, it is considered rape if a person engages in sexual conduct with another individual who is not their spouse, under specific circumstances. These circumstances include impairing the other person’s judgment by administering a drug or other intoxicant, using force, the threat of force, or deception. It also includes situations where the person is less than 13 years old, regardless of whether the offender is aware of their age. The law further states that rape occurs if a person engages in sexual conduct with another and compels the other person by force or the threat of force.
The penalties for rape in Ohio are severe and vary depending on several factors, but all rape charges are classified as First Degree Felonies. If convicted of administering drugs or intoxicants, or using force, and if the victim was under 16 years old at the time of the offense without causing serious physical harm and was 10 years or older, the sentence ranges from a mandatory 3 to 11 years in prison. For those convicted of administering a scheduled controlled substance, the minimum sentence is 5 years, with a maximum of 11 years.
If the victim was under the age of 13, the mandatory sentence is 10 years to life in prison. If the victim was under the age of 10, the mandatory sentence increases to 15 years to life. In cases where the victim was under the age of 13 and the offender caused serious physical harm or if the victim was 13 and the offender used force or threat of force, the sentence can be 25 years to life or even life without parole.
