Understanding Weapons Crimes and Charges
Many weapons crimes in Ohio are listed in Chapter 2923 of the Ohio Revised Code. These offenses include conspiracy, attempt to commit an offense, complicity, carrying concealed weapons, possession of a firearm in beer or liquor permit premises, illegal conveyance or possession of a deadly weapon or dangerous ordnance or of an object indistinguishable from a firearm in a school safety zone, and illegal conveyance of a deadly weapon or dangerous ordnance into a courthouse. Additionally, transporting or storing a firearm or ammunition on private property, falsification of a concealed handgun license, having weapons while under disability, possession of a deadly weapon while under detention, use of a firearm or dangerous ordnance by a violent career criminal, using weapons while intoxicated, and improperly handling firearms in a motor vehicle are also included.
Improperly discharging a firearm at or into a habitation, in a school safety zone, or with intent to cause harm or panic to persons in a school building or at a school function is another serious charge. Other offenses include discharge of a firearm on or near prohibited premises, unlawful possession of dangerous ordnance, failure to secure dangerous ordnance, unlawful transaction in weapons, possessing a defaced firearm, improperly furnishing firearms to a minor, underage purchase of a firearm or handgun, possessing criminal tools, engaging in a pattern of corrupt activity, and participating in a criminal gang.
Penalties for Weapons Crimes
The penalties for weapons crimes in Ohio vary depending on whether the offense is a misdemeanor or a felony. Misdemeanors are typically punished as follows. A first-degree misdemeanor can result in up to 180 days in jail and a fine of up to $1,000. A second-degree misdemeanor can lead to up to 90 days in jail and a fine of up to $750. A third-degree misdemeanor can result in up to 60 days in jail and a fine of up to $500. A fourth-degree misdemeanor can lead to up to 30 days in jail and a fine of up to $250.
Felony convictions carry harsher penalties. A first-degree felony can result in three to 11 years in prison and a fine of up to $20,000. A second-degree felony can lead to two to eight years in prison and a fine of up to $15,000. A third-degree felony can result in nine to 36 months (up to five years in some cases) in prison and a fine of up to $10,000. A fourth-degree felony can lead to six to 18 months in prison and a fine of up to $5,000. A fifth-degree felony can result in six to 12 months in prison and a fine of up to $2,500. The sentence imposed will depend on various factors, including the offender’s prior criminal record, the specific offense involved, and where the alleged offense was committed.
Definitions of Weapons in Ohio
Ohio law provides specific definitions for different types of weapons. A deadly weapon is defined as any instrument, device, or thing capable of inflicting death, designed or adapted for use as a weapon, or possessed, carried, or used as a weapon. A firearm is defined as any deadly weapon capable of expelling or propelling one or more projectiles by the action of an explosive or combustible propellant.
A handgun is defined as any firearm with a short stock, designed to be held and fired with one hand, or any combination of parts from which such a firearm can be assembled. A semi-automatic firearm is defined as any firearm designed to fire a single cartridge and automatically chamber a succeeding cartridge with a single function of the trigger. An automatic firearm is defined as any firearm designed to fire a succession of cartridges with a single function of the trigger.
A sawed-off firearm is defined as a shotgun with a barrel less than eighteen inches long, a rifle with a barrel less than sixteen inches long, or a shotgun or rifle less than twenty-six inches long overall. Dangerous ordnance includes any automatic or sawed-off firearm, zip-gun, ballistic knife, explosive device, incendiary device, or other high explosives, and various other military weapons or their ammunition.
