The state of Ohio defines theft offenses under the Ohio Revised Code § 2913.01(K). These offenses include a wide range of activities, such as aggravated robbery, robbery, aggravated burglary, burglary, breaking and entering, safecracking, tampering with coin machines, theft, unauthorized use of a vehicle, and unauthorized use of property. Other crimes under this code include possession or sale of unauthorized cable television devices, telecommunications fraud, unlawful use of telecommunications devices, passing bad checks, misuse of credit cards, forgery, criminal simulation, making or using slugs, trademark counterfeiting, Medicaid fraud, tampering with records, securing writings by deception, personating an officer, defrauding creditors, insurance fraud, workers’ compensation fraud, receiving stolen property, cheating or corrupting sports, and theft in office.
These offenses are graded differently based on the type of crime and the value of the property involved. For instance, less valuable items might result in misdemeanor charges, while more expensive goods could lead to felony charges.
The penalties for theft convictions in Ohio can be severe. For misdemeanor offenses, the punishments vary depending on the degree. A first-degree misdemeanor could result in up to 180 days in jail and a fine of up to $1,000. A second-degree misdemeanor might lead to up to 90 days in jail and a fine of up to $750. Third-degree misdemeanors can result in up to 60 days in jail and a fine of up to $500. Fourth-degree misdemeanors may involve up to 30 days in jail and a fine of up to $250.
For felony theft offenses, the consequences are even more significant. A first-degree felony could mean three to eleven years in prison and a fine of up to $20,000. A second-degree felony might lead to two to eight years in prison and a fine of up to $15,000. Third-degree felonies can result in nine to 36 months in prison, and in some cases, up to five years, along with a fine of up to $10,000. Fourth-degree felonies may involve six to 18 months in prison and a fine of up to $5,000. Fifth-degree felonies could lead to six to 12 months in prison and a fine of up to $2,500.
Some individuals may receive probation instead of prison time, but it is crucial to follow all court requirements strictly. Violating probation terms can result in serving the original maximum sentence for the underlying crime.
Beyond the immediate penalties, theft convictions can lead to long-term difficulties. A criminal record can make it challenging to find housing, secure employment, or obtain professional licenses. Even if you are offered a plea deal to a reduced charge, it is important to consider these potential consequences.
