Drugged driving, also known as operating a vehicle under the influence (OVI), involves operating a vehicle while impaired by drugs. This can include illegal drugs, prescription medications, and over-the-counter drugs. In Ohio, OVI laws are strict and drug-related OVI offenses carry the same penalties as alcohol-related OVI offenses. Ohio Revised Code § 4511.19 is the state law that addresses operating a vehicle under the influence of alcohol or drugs. The law outlines various methods of testing for controlled substances, which can be detected in blood or urine tests.
Drugged driving offenses can involve a variety of substances, each with different detection times in the body. Some common types of drugged driving crimes include marijuana OVI, prescription Drug OVI, cocaine OVI, methamphetamine OVI, and heroin OVI. The type of drug involved is crucial because different drugs remain in the body for varying lengths of time. For instance, cocaine may be detectable for one day, while marijuana can be detected for up to 30 days depending on usage.
Drugged driving convictions in Ohio carry serious penalties, similar to those for drunk driving. These penalties escalate with repeat offenses within a 10-year “lookback period.” The lookback period refers to the time frame in which previous convictions can be used against an individual. Here are the general penalties for OVI offenses in Ohio:
A first OVI offense in 10 years is a first-degree misdemeanor and can result in three days to six months in jail and a fine ranging from $375 to $1,075. There is also a driver’s license suspension of up to three years, with driving privileges possible after 15 days, and an ignition interlock device may be required for unlimited driving privileges.
A second OVI offense in 10 years is also a first-degree misdemeanor, punishable by 10 days to six months in jail and a fine ranging from $525 to $1,625. Mandatory treatment is required, along with a driver’s license suspension of up to seven years. Driving privileges may be granted after 45 days, and an ignition interlock device may be required if the offense involved alcohol.
A third OVI offense in 10 years is an unclassified misdemeanor, punishable by 30 days to one year in jail and a fine between $850 and $2,750. A mandatory alcohol or drug addiction program is required, with a driver’s license suspension of up to 12 years. Driving privileges may be granted after 180 days, and an ignition interlock device may be required if the offense involved alcohol, with possible vehicle forfeiture.
For a fourth or fifth OVI in 10 years, or a sixth OVI in 20 years, the charge becomes a fourth-degree felony. This can result in 60 days to one year in prison and a fine between $1,350 and $10,500. A mandatory alcohol or drug addiction program is required, with a driver’s license suspension of up to life. Driving privileges may be granted after three years, with an ignition interlock device required if the offense involved alcohol, and possible vehicle forfeiture.
A second felony OVI in a lifetime is a third-degree felony, punishable by 60 days to 36 months in prison and a fine between $1,350 and $10,500. A mandatory alcohol or drug addiction program is required, with a driver’s license suspension of up to life. Driving privileges may be granted after three years, with an ignition interlock device required if the offense involved alcohol, and possible vehicle forfeiture.
Prescription drug OVI offenses involve driving under the influence of medications that have impairing effects. According to the National Institute on Drug Abuse (NIDA), the most commonly abused prescription drugs fall into several categories. Depressants include barbiturates like Amytal and Nembutal, benzodiazepines like Valium and Xanax, and sleep medications like Ambien and Lunesta. Opioids and morphine derivatives include drugs like codeine, morphine, methadone, fentanyl, oxycodone, and hydrocodone. Stimulants include amphetamines like Adderall and methylphenidate like Ritalin. Other compounds found in some cough and cold medications can also impair driving ability.

It’s crucial to avoid common mistakes that could negatively impact your case. Speaking too much or admitting guilt can complicate your defense. Instead, politely inform the officers that you wish to speak to an attorney before answering any questions.
Another mistake to avoid is neglecting to seek legal representation immediately. The sooner you contact experienced Columbus drugged driving attorneys at Sabol Mallory LLC, the better your chances of building a strong defense. Waiting too long can result in missed opportunities to gather crucial evidence or witness statements that could be beneficial to your case.
