Robbery in Ohio is defined under the Ohio Revised Code § 2911.02. A person commits robbery if they have a deadly weapon on or near them, inflict or threaten to inflict physical harm, or use or threaten to use force while trying to commit a theft or while fleeing after the attempt or offense. If the robbery involves using or threatening to use force, it’s classified as a third-degree felony, which can result in a prison sentence of nine months to five years and fines up to $10,000. However, if the crime involves a deadly weapon or the infliction of harm, it becomes a second-degree felony, punishable by two to eight years in prison and fines up to $15,000.
More severe is aggravated robbery, as defined by Ohio Revised Code § 2911.01(A). This occurs when someone, during a theft or while fleeing afterward, has a deadly weapon and displays, brandishes, or uses it, possesses dangerous ordnance, or inflicts serious physical harm. Additionally, under Ohio Revised Code § 2911.01(B), aggravated robbery includes knowingly trying to take a deadly weapon from a law enforcement officer. This crime is a first-degree felony, with penalties ranging from three to 11 years in prison and fines up to $20,000.
Convictions for robbery carry severe consequences. A third-degree felony can lead to up to five years in prison and a $10,000 fine. A second-degree felony can result in up to eight years in prison and a $15,000 fine. The most serious, a first-degree felony, can lead to up to 11 years in prison and a $20,000 fine.
