Carry Concealed Weapons Violation

CRIMINAL

In the state of Ohio, citizens have the right to carry concealed weapons (CCW). However, while this is a right that is afforded to citizens, there are laws, guidelines, and regulations that come along with this privilege. Therefore, individuals have the right to carry their concealed weapons, but failure to this in compliance with state laws and regulations can land someone in serious trouble with the state law.

While we can all agree that it is important for individuals to take handgun safety classes before they start carrying weaponry around, it is also important to learn about state laws and regulations. This can help you understand the laws pertaining to your situation and help you potentially avoid being charged with a misdemeanor and/or felony.

CCW Requirements

If you want to have a CCW license in Ohio, you must first fulfill any and all requirements the state government has deemed necessary. The requirements for having a CCW license in Columbus are as follows:

● 21 years of age or older

● Submitted fingerprints

● 45 days or more of Ohio residency

● Certification of competency

● A photograph of oneself that was taken within the last 30 days

● 30 days of residency in the county issuing the license

● A completed application that has been submitted to the Concealed Carry Permit Office

However, keep in mind that having a Concealed Carry Permit does not give individuals the right to carry any type of weapon with them. Carrying a deadly weapon other than a handgun or any other type of dangerous ordnance is against law. According to ORC 2923.11, dangerous ordnance can be any of the following weapons:

(1) Any automatic or sawed-off firearm, zip-gun, or ballistic knife;

(2) Any explosive device or incendiary device;

(3) Nitroglycerin, nitrocellulose, nitrostarch, PETN, cyclonite, TNT, picric acid, and other high explosives; amatol, tritonal, tetrytol, pentolite, pecretol, cyclotol, and other high explosive compositions; plastic explosives; dynamite, blasting gelatin, gelatin dynamite, sensitized ammonium nitrate, liquid-oxygen blasting explosives, blasting powder, and other blasting agents; and any other explosive substance having sufficient brisance or power to be particularly suitable for use as a military explosive, or for use in mining, quarrying, excavating, or demolitions;

(4) Any firearm, rocket launcher, mortar, artillery piece, grenade, mine, bomb, torpedo, or similar weapon, designed and manufactured for military purposes, and the ammunition for that weapon;

(5) Any firearm muffler or silencer;

(6) Any combination of parts that is intended by the owner for use in converting any firearm or other device into a dangerous ordnance.

CCW Laws

There are laws and guidelines that Concealed Carry Permit owners must adhere to if they want to keep their license in good standing. Law enforcement must ensure the safety of the general public, which means that even though some individuals are allowed to carry concealed weapons, they must still follow the laws that are set in place to keep people safe. Many of these laws come into play when a Concealed Carry Permit owner is approached by a police officer.

When approached by a law enforcement officer, CCW holders must remember to inform the officer that they have a Concealed Carry Permit and are currently carrying a concealed weapon. They must keep their hands in plain sight at all times and refrain from attempting to reach for their weapon. Following these guidelines and complying with the police officer who has approached you is critically important for all CCW holders. You must be aware of these nuances of the law and the way in which you must conduct yourself as a CCW holder. Making sure you are following guidelines doesn’t only help you keep your Concealed Carry Permit in good standing. It also helps law enforcement remain cool, calm and collected during their encounters with CCW holders in Columbus, Ohio.

Penalties Related to CCW

CCW penalties and violations can range from first-degree misdemeanors to fourth-degree felonies. For example, if an individual is in a restricted area and fails to present a Concealed Carry Permit when asked, they can be arrested for a first-degree misdemeanor. If a  person is a repeat CCW violator and they attempt to draw their concealed weapon during a stop conducted by law enforcement, they may face automatic fourth-degree felony charges.

In addition to these charges, individuals can face first-degree misdemeanor charges if they fail to disclose their concealed weapon to a law enforcement officer during a traffic stop.

As you can tell, these charges can be hard to understand. As a result, you’ll need the help of a criminal defense attorney to make sure you know exactly what you’re up against.
